Rules that apply in traditional apartment complexes typically apply in homes, such as maintenance and repairs, limits on a landlord’s right to enter the rental space and security deposit requirements.
Question: In these tough financial times I think a lot of people (myself included) are considering renting out part of their home, if not already doing so. I haven’t been successful in trying to look up what the law says about renting a room or part of your house. I read this is different from renting a duplex or regular rental property. Can you provide any guidance?
Answer: Your question is timely because many homeowners facing mortgage or other economic stresses are looking at room rentals as an option to increase their income. Most of the state laws governing tenant-landlord relationships in traditional apartment complexes apply equally to the room rental you are describing. For example, the requirements for performing maintenance and repairs, the limits on a landlord’s right to enter the rental premises and the security deposit requirements all apply.

The rental laws change continuously, as a homeowner it is oftentimes difficult to keep up with all the changes. A professional property manager will educate homeowners on the rental law and making them aware of changes to make sure they do not violate against the rental law. More than that, a professional property manager and his trained and knowledgeable staff know how to deal with tenant requests, complaints and other assignments, which a homeowner has to deal with when leasing a property.
Whether you don’t have the time to manage your property or it is because of a lack of knowledge, professional property management services can be a big asset.
AMSI’s property manager Nathan Murdock, San Francisco Apartment Association property manager of the year, will be dedicated to assist you with your property management needs and answers questions you may have.

Property Manager of the Year (500-Plus Units): Nathan Murdock, AMSI
by Heather Boerner, SFAA
As head of the property management division for AMSI, Nathan Murdock has served small and large property owners for 11 years. In that time, he’s learned the attention to detail that allows him to follow up on any request, no matter how small, and learned the best way to serve property owners’ interests. “Property owners rely on me more than ever in this economy to look after their best interests, keep expenses low and maintain efficient rent collection so that cash flow remains steady during this slow economy,” he says. “I am most proud of my dedication to service the property owner’s best interest.”
This is Murdock’s first Trophy win, and the honor means a lot to him. “I feel truly honored to win this award from such a well-respected industry organization as the SFAA,” says Murdock, who keeps his award on his desk so all his clients and colleagues can see it. “I look forward to throwing my name into the ring again next year. I am always thrilled to be involved in San Francisco Apartment Association events.”

In a previous post I wrote about more flexibility with corporate housing for homeowners. How one of the biggest benefits is that homeowners can still use their own property due to short-term tenants. If you missed the article you will find it here: More Flexibility with Corporate Housing.
However, this is just one of the many benefits of corporate housing. The biggest benefit is the money homeowners can make out of renting out their vacant property. Whenever a property sits vacant it costs homeowners money. Instead why not renting it out to qualified corporate clients and earning money whenever the property is vacant?
